Terms of Use — Proword for Android

These Terms of Use (“Terms”) govern your use of the Android version of
Proword (the “App”). The iOS version of Proword is covered by a separate
document at oleksi.dev/proword-terms.

By downloading, installing, or using the App you agree to these Terms and
to the Privacy Policy. If you
do not agree, do not use the App.

1. Who we are

Proword is published by an independent developer (“we”, “our”, “us”):

2. Eligibility

You must be at least 13 years old to use the App. If the age of
digital consent in your country is higher (for example 16 in parts of the
European Economic Area), you must meet that age, or have verifiable
parental consent. The App is a general-audience product and is not directed at children
— it is not enrolled in Google Play’s Designed-for-Families programme.
We do not knowingly allow under-13 users.

3. Your account

The App uses Google Sign-In via Firebase Authentication. You are
responsible for keeping access to your Google account secure. We do not
store your Google password. You may delete your account at any time —
see Section 13.

4. Licence to use the App

We grant you a personal, non-exclusive, non-transferable, revocable
licence to install and use the App on Android devices you own or control,
for your own personal, non-commercial language-learning use, subject to
these Terms and the Google Play Terms of Service.

5. Subscriptions, billing, and refunds

The App offers an optional Proword Premium subscription that unlocks
unlimited words, unlimited practice sessions, and cloud AI features.

• Plans. Premium is offered as an auto-renewing monthly plan and
  an auto-renewing yearly plan. Current prices are shown inside the
  App on the paywall screen before you purchase, in your local currency.
• Payment processor. All purchases are processed by Google Play
  Billing. We never receive or store your card number, billing
  address, or other payment details.
• Auto-renewal. A subscription renews automatically at the end of
  each billing period unless you cancel at least 24 hours before the
  period ends. Your Google account is charged for renewal within 24
  hours before the end of the current period.
• Managing or cancelling. Manage or cancel a subscription any time in
  the Google Play Store → Subscriptions. Cancelling stops future
  renewals; you keep Premium access until the end of the period already
  paid for.
• Restoring purchases. If you reinstall the App or switch devices,
  use Settings → Restore Purchases to recover an active subscription
  tied to your Google account.
• Refunds. Purchases are subject to Google Play’s refund policy;
  request refunds through Google Play, not through us. Nothing in these
  Terms limits any non-waivable statutory consumer rights you have,
  including any statutory right of withdrawal for digital purchases in
  your jurisdiction.
• Price changes. If we change subscription prices, the change applies
  only to future billing periods, and Google Play will notify you and
  ask for your consent where required before any increased charge.

6. Free tier and usage limits

The App can be used free of charge with the following limits:

• A lifetime cap on the number of words a free user can add.
• When the cap is reached, the App offers a choice to subscribe to
  Premium. Declining simply closes the prompt — nothing is charged.

No advertising. Proword contains zero advertisements — no
banners, no interstitials, no rewarded ads — for free or Premium users.
The only monetisation model is the optional Premium subscription.

Consent form. In the European Economic Area, the United Kingdom, and
California, a Google User Messaging Platform consent form is shown on
first launch. This consent is required by the Meta and TikTok
attribution SDKs we use to measure paid install campaigns — it is not
for advertising inside the App.

7. AI-generated content

For example sentences, transcriptions, mnemonics, and related words, the
App may use Google’s Gemini models via Firebase AI Logic (Premium) or
on-device models (where supported). AI output may be inaccurate,
incomplete, or unsuitable for a given context. It is provided as a
learning aid only — verify anything important before relying on it. You
must not use the App’s AI features to generate unlawful, infringing, or
abusive content.

8. Your content

Words, translations, flashcards, and practice progress you create in the
App (“Your Content”) are stored in app-private storage on your device and
in our Firebase backend tied to your account. You retain ownership of
Your Content. You grant us a limited licence to store and process Your
Content solely to operate the App for you (for example, to sync your
subscription state and generate AI examples). We do not sell Your Content
or use it for advertising. See the
Privacy Policy for detail.

9. Acceptable use

You agree not to:

• reverse-engineer, decompile, disassemble, or attempt to extract the
  source code of the App, except to the extent this restriction is
  prohibited by applicable law;
• circumvent, disable, or interfere with usage limits, the paywall,
  Firebase App Check, or any security or licensing mechanism;
• use the App, its cloud functions, or its AI features in a way that is
  unlawful, abusive, or that places an unreasonable load on our backend;
• resell, sublicense, or commercially redistribute the App or access to
  its paid features;
• use the App to infringe the intellectual-property or privacy rights of
  others.

We may suspend or terminate access if you materially breach this section.

10. Intellectual property

The App, its name, mascot, artwork, animations, sounds, and code are
owned by us or our licensors and are protected by intellectual-property
law. Except for the licence in Section 4, these Terms grant you no rights
in them. Image search results are provided by Pixabay and remain
subject to the Pixabay Content Licence.

11. Third-party services

The App relies on third-party services, each governed by its own terms
and privacy policy:

We are not responsible for third-party services and do not control their
content or availability.

12. Disclaimer of warranties

The App is provided “as is” and “as available”, without warranties of
any kind, whether express or implied, including fitness for a particular
purpose, accuracy of AI or translation output, or uninterrupted or
error-free operation. Some jurisdictions do not allow the exclusion of
implied warranties, so parts of this section may not apply to you.

13. Account deletion and termination

• You may stop using the App at any time and delete your account from
  Settings → Account → Delete account, or from the web at
  https://oleksi.dev/proword-delete-account/ with no install required.
• We may suspend or terminate your access if you breach these Terms,
  if required by law, or if we discontinue the App. Where reasonable and
  lawful we will give notice.
• Deleting your account does not by itself entitle you to a refund of an
  unused subscription period; refund eligibility is governed by Section 5.

14. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect,
incidental, special, or consequential damages, or for loss of data,
profits, or learning progress, arising from your use of or inability to
use the App. Our total aggregate liability for any claim relating to the
App is limited to the greater of the amount you paid us for the App in
the 12 months before the claim, or USD 50. Nothing in these Terms
limits liability that cannot lawfully be limited — including liability
for death or personal injury caused by negligence, for fraud, or any
non-waivable consumer-protection rights.

15. Changes to the App and to these Terms

We may update, change, or discontinue features of the App. We may also
update these Terms; when we do, we will change the “Effective date” above
and post a notice in the App’s What’s New screen for material changes.
Continued use of the App after a change takes effect means you accept the
updated Terms. If you do not accept them, stop using the App.

16. Governing law

These Terms are governed by the laws of Ukraine, without regard to
conflict-of-law rules. If you are a consumer, this choice of law does not
deprive you of the protection of mandatory consumer-law provisions of the
country in which you habitually reside, and you may bring proceedings in
the courts of that country where the law allows.
