Terms of Use for Proword

Welcome to Proword! These Terms of Use (“Terms”) govern your use of the Proword iOS app (“the App”), provided by Oleksii Mykhalchuk (“we,” “us,” or “our”). By using the App, you agree to these Terms. If you do not agree, please do not use the App.

Using the App

Proword is a language learning app offering features like flashcards, quizzes, speech recognition, speech synthesis, text reading via camera, translation, and image search. To use the App, you must create an account using Apple Sign-In.

  • Eligibility: There are no age or verification restrictions for creating an account, but users under 13 must have parental consent to comply with applicable laws.
  • Subscriptions: The App offers monthly, half-yearly, and yearly subscription tiers via Apple In-App Purchases. All payments are processed by Apple, and no refunds are offered.
  • Acceptable Use: You may not reverse-engineer, decompile, or attempt to extract the source code of the App. You are responsible for maintaining the security of your account credentials.

User Content

Any content you create in the App (e.g., custom flashcards) is stored locally on your device and in iCloud associated with your Apple ID. You retain ownership of your content, and we do not claim any rights to it.

Third-Party Services

Proword integrates with third-party services, including:

  • Apple In-App Purchases
  • Pixabay Image API
  • Google Translate API
  • Open AI API
  • Firebase
  • Facebook SDK

Your use of these services is subject to their respective terms and policies.

No Warranties

The App is provided “as is” without warranties of any kind. We do not guarantee the accuracy, completeness, or effectiveness of the App’s features, including its language learning outcomes. While we suggest that using the App for 5 minutes daily may boost your vocabulary within a month, individual results may vary.

Limitation of Liability

We are not liable for any damages, including data loss, app errors, or service interruptions, to the fullest extent permitted by law. Your use of the App is at your own risk.

Termination

We may suspend or terminate your access to the App at our discretion, without notice, for any reason, including violation of these Terms.

Changes to These Terms

We may update these Terms to reflect changes in our practices or legal requirements. We will notify you of significant changes via push notifications or email. Your continued use of the App after such changes constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of Ukraine. Any disputes arising from these Terms or your use of the App will be resolved under Ukrainian jurisdiction, though we do not currently have a specific dispute resolution process in place.
